I was the I/O psychologist for the case and have seen several legal problems as well as ethical issues. There is the possibility of discrimination when selecting for leadership development programs. The Equal Employment Opportunity Commission (EEOC) states that it is against the law to discriminate based on race, color or religion. A structured interview process that is predetermined to meet job requirements is recommended in order for fairness and impartiality. A conflict of interests could also pose a problem. I have a legal obligation as an I/O psychology to ensure fairness and objectivity at work (APA 2019). To avoid conflicts of interests, I recommend using a selection panel made up members from various departments within an organization. This will ensure that the process of selection is fair and transparent. Not only are there ethical questions to consider, but so do legal ones. The Americans with Disabilities Act (ADA), for example, requires employers to provide reasonable accommodation for persons with disabilities. (ADA, n.d.). To ensure that this law is adhered to, I recommend including people with disabilities in the selection process.
